Welcome to mywaggle.ca, a platform owned and operated by Nimble Wireless, Inc. In this Terms of Use agreement, the terms "Nimble," "Waggle," "we," "us," and "our" refer to Nimble Wireless, Inc. The terms "you," "your," "user," and "subscriber" refer to you as a user residing in Canada.

By accessing this mobile application or website, you agree to the following Terms of Service under which our services are offered.

1. Description of Service Waggle provides mobile applications and web services to monitor environmental conditions, pet activities, asset locations, and various industrial parameters. These services are available for personal, residential, recreational, and commercial uses, including but not limited to monitoring temperature, pressure, GPS location, pet activity, and real-time video/audio feeds.

2. Consent to Storage/Use of Location Information When using our location-enabled services, Waggle collects data including GPS coordinates and network information from connected tracking devices. This data is securely stored and used solely for service delivery, troubleshooting, and service improvement purposes. Location information is only shared when legally required under Canadian laws or regulations.

3. Availability of Service Waggle aims to provide 24/7 service, but interruptions may occur due to maintenance, technical issues, or network disruptions. We will make reasonable efforts to notify users in advance of planned outages.

4. Modification of Terms Waggle may revise these Terms of Service at any time. Updates will be sent via email or posted on the website. Continued use of the services following such changes constitutes acceptance of the revised terms.

5. Personal Information and Privacy Users are responsible for maintaining the confidentiality of their login credentials. Any unauthorized access must be reported to Waggle immediately. Waggle complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws.

5.1 Cookies Our website uses cookies to enhance user experience. These do not store personally identifiable information. Users can disable cookies, although some features may not function properly.

5.2 Changes to Privacy Policy We will notify users of significant changes to our Privacy Policy via email and update our website accordingly.

5.3 Data Security We implement appropriate organizational and technical safeguards to protect user data. However, no online system is entirely secure. Users are also responsible for protecting their own account credentials.

5.4 Data Retention Waggle does not retain tracking or user data beyond the operational requirements of its services. Information is deleted as per internal policies and Canadian data protection laws.

6. Financial Arrangements Fees and payment terms are outlined in the service agreement or during the ordering process. All charges are listed in Canadian Dollars (CAD) unless specified.

7. User Warranties Users agree to use Waggle services lawfully, provide accurate information, and not engage in unauthorized, illegal, or malicious activities. Violations may result in suspension or termination of services.

8. Intellectual Property Users retain rights to their original content but grant Waggle a license to use such content for promotional or service improvement purposes. All Waggle software and proprietary files remain the property of Nimble Wireless, Inc.

9. Assignment You may not transfer your rights or responsibilities under this agreement without prior written approval from Waggle.

10. User-Generated Content (UGC) By submitting content, you grant Waggle a license to use it in line with Canadian copyright laws. Waggle reserves the right to moderate or remove inappropriate content.

11. Restrictions on Use Users must not use Waggle services for illegal purposes or to transmit harmful, offensive, or infringing material. Violations will be investigated and may be reported to Canadian law enforcement.

12. Disclaimer of Warranties Services are provided "as-is" without any guarantees. While we strive to maintain service quality, we do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability To the maximum extent permitted by Canadian law, Waggle is not liable for indirect or consequential damages. Our total liability shall not exceed the amount paid by you for the applicable service.

14. Indemnification You agree to indemnify Waggle against any claims, damages, or legal costs arising from your misuse of the services or violation of these terms.

15. Suspension and Termination Waggle may suspend or terminate your access for breach of terms, illegal activity, or prolonged inactivity. Users may also request account termination at any time.

16. Governing Law and Jurisdiction These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. Any disputes will be resolved under the jurisdiction of Ontario courts.

17. Arbitration In case of disputes, both parties agree to arbitration under Canadian Arbitration Association rules. The arbitration will take place in Ontario, Canada.

18. Severability If any provision of these Terms is found invalid under applicable law, the remainder will remain in full effect.

19. Entire Agreement These Terms represent the entire agreement between the user and Waggle concerning the use of services in Canada.
